Un fallo judicial condenó a la Policía Federal a indemnizar con una suma de 85.500 pesos a la viuda y los tres hijos de un hombre que falleció cuando se encontraba robando en un garaje del barrio de Flores y resultó baleado por efectivos policiales, que lo habían sorprendido “in fraganti”. Los magistrados motivaron su decisión en el “dolor” que provocó la muerte del hombre entre sus familiares. Se trata de un fallo de la Cámara Nacional de Apelaciones en lo Civil y Comercial Federal, con la firma de los jueces Martín Diego Farrell y María Susana Najurieta, en el marco de una causa iniciada el 16 de agosto de 1995, cuando Raúl Fussetti ingresó con fines delictivos -en compañía de otro hombre- a un garaje ubicado en Camacuá al 100 de Capital Federal. Tras reducir al encargado del estacionamiento, los delincuentes se enfrentaron con cuatro policías, incluido el comisario Daniel Nicuesa, en ese entonces jefe de la seccional 38ª. El resultado fue la muerte a balazos de Fussetti y su amigo, identificado como Alejandro Samad. Por este caso, el jefe policial fue condenado por exceso en legítima defensa, y separado de su cargo.
